Updated Antitrust Guidelines for IP Licensing Issued by the Department of Justice and Federal Trade Commission

For the first time in nearly 20 years, the Department of Justice Antitrust Division (DOJ) and the Federal Trade Commission (FTC) issued updated Antitrust Guidelines for the Licensing of Intellectual Property.

The updated guidelines reflect several significant changes in antitrust and IP law that since 1995, including:

  • the 2010 Horizontal Merger Guidelines;
  • the 2007 and 2011 reports from the DOJ and the FTC on the intersection of antitrust and IP;
  • change in new technology evaluation timeline;
  • and the evaluation of research and development markets.
